My best friend was going to CVS with some of her friends, but these bunch of black girls just pointed at her just because she was 'white'. So one of her friends stood up for my best friend and told to back off, etc, etc. So later on, those black girls called the cops on my best friend and her friends. The cops and arrested them... WITHOUT reading their rights AT ALL.

They just cuffed 'em and that's it. And those cops were physically hurting them bad; slamming her against the car and whatnot. Later on, they released her because she was 100% innocent but without an apology.

Seriously, that's just shit. Those cops are worse than LAPD. :CStern:

And they didn't read her her rights. Won't they get fired for that? Seriously, if I was there I'd chant "Miranda v. Arizona" non-stop to make them piss their pants.

They were falsely arrested for "provoking and engaging" in a fight, which they didn't. Those black girls were just dumb lying bitches with no morality.

If this is true, your friends may be in great luck. It would require money for a good lawyer and then it would be the word of the cops against theirs, but the courts could very well end up giving them a reimbursement for the injustice.

Indeed.

And yes, rights must be read at the time of arrest, as well as notification of your right to an attorney, and so on and so forth. Unless of course, there are time constraints, like an emergency arrest, such as a mob scene.

CVS is a pharmacy. Oh, and police are required to read your Miranda Rights immediately upon arresting you.

Depending on the cops' records, whether or not your friends have any criminal record or other past dirt, and simply how convincing your lawyer manages to be... It could go either way. They could waste money on the lawyer to get nothing, or end up with a nice sum of cash to make up for the way they were treated.

The judge would have to make the call. Even if they did read the accused their rights, it's still a scandal and a problem if the accused claims they did not. Plus, if the cops arrested the accused right by their police cruiser, then they should have the arrest on tape. The officers would have to have written up a full report detailing the arrest as well. Minute-by-minute. People forget; for every act in policing, there's about five pages of a report to hand in. An officer draws his gun, he has to write up an entire report detailing why, how, when, what the situation was, and so on. And it all has to be reasonably sound, responsible, and procedural.

Sloppy police work, such as forgetting to read someone their rights, is usually easy to spot. The officers in question probably have a history of ****ing up procedure.

One of the kid came cleanly with the cops and did everything the cops asked, my best friend and the other were so fed up so they showed resistance. Vulgar resistance and retaliation. But just enough to piss off the cops. As far as I know, their records are clean (except my best friend has skipped school a lot). That's the only problem, really.

Thanks for the advice, I'll inform her. However, her mom lacks funding for an attorney because my best friend recently recovered from a staph infection and blood poisoning. Lots of medical bills have been paid so they're short on cash. That's another issue. But like you said, the payoff is good...

Or more realistically your friends got there rights read to them but weren't listening/were going mental/lying to make there situation better.

Even if they were lying, which is highly unlikely as all three wouldn't go mental at once (in fact, one of the friends were completely calm and complied to the cops), they still didn't state the reason why they were being arrested. They put them in a dark room and kept them there.

No offense but there is clearly more to this then your stating. No policeman in there right mind would forget to give someone there rights the stick them in a dark room without an explanation.

It would be beyond stupid.

You have any idea how much that happens? People get off all the time due to shoddy police work or a break in procedure.

I have heard that sometimes your school record plays a part.
If they have marks, from the police, I'd tell them to go for it. Also have a doctor check them out.
Also don't they require more witnesses than just the "victims" and some sort of evidence that there was fight?

So what is more likely to you Kurt? The situation of everything Vin said or his friends bending the truth to make themselves look even more hard done by.
